Terms of Service

1. Who we are

KeyTrack is operated by Creative Automated Simulations ("we", "us", "our"). You can reach us at creativeautomatedsimulations@gmail.com. When you use KeyTrack you are contracting with Creative Automated Simulations.

2. Acceptance

By creating an account, accessing, or otherwise using KeyTrack, you agree to be bound by these Terms, our Privacy Notice, our Acceptable Use Policy, and our Refund Policy. If you are using KeyTrack on behalf of an organization, you confirm that you have the authority to bind that organization. If you are an individual, you confirm that you are of legal age to form a binding contract.

3. The service

KeyTrack is a software-as-a-service application that helps property managers, cleaning companies, locksmiths and similar teams track the physical keys, key sets and access codes they hold for the properties they service, including check-in / check-out scanning via QR codes and an audit log of those events.

You are responsible for the physical custody and security of the actual keys and codes. KeyTrack is a tracking and record-keeping tool only; it does not itself secure, control, store, or guarantee the safety of any key, lock or property.

4. Your account

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your password and login credentials confidential.
• You are responsible for all activity that occurs under your account and the accounts of team members you invite.

5. Acceptable use

You agree not to misuse KeyTrack. In particular, you must not:

• Use the service for any unlawful, fraudulent or deceptive purpose.
• Send spam or harvest data from other users.
• Infringe the intellectual property, privacy, or other rights of any person.
• Interfere with the security or integrity of the service — including by introducing malware, probing or scanning for vulnerabilities, scraping, or attempting to bypass our technical or fair-use limits.
• Resell, sublicense, or redistribute access to the service.
• Reverse engineer, decompile, or otherwise attempt to derive the source code of the service except to the extent permitted by mandatory law.

6. Fees, billing and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is also subject to Paddle's Buyer Terms which cover payment, billing, tax, cancellation and refund mechanics.

Refund eligibility is described in our Refund Policy. Subscriptions renew automatically until cancelled. You may cancel at any time, in which case you keep access until the end of the current billing period.

7. Intellectual property

KeyTrack, including its software, design, branding and documentation, is owned by Creative Automated Simulations and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service for your internal business operations during the term of your subscription.

You retain all rights to the content you put into KeyTrack (your properties, key sets, notes, history, etc.). You grant us a limited license to host, process, and display that content solely so we can provide the service to you.

8. Service level

We work hard to keep KeyTrack reliable, but we do not guarantee that it will be uninterrupted, error-free, or always available. The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability for any claims arising from or relating to the service is limited to the fees you paid us in the twelve months before the claim arose. We are not liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as for fraud, death or personal injury caused by negligence).

10. Indemnity

You agree to indemnify and hold harmless Creative Automated Simulations from any claims, damages, costs and expenses (including reasonable legal fees) arising out of: your content, your use of the service in violation of these Terms, or your violation of any law or third-party rights.

11. Suspension and termination

We may suspend or terminate your access to KeyTrack, with or without notice, if: (a) you materially breach these Terms; (b) your payment fails and remains unpaid after a reasonable cure period; (c) we reasonably believe your account presents a security or fraud risk; or (d) you repeatedly or seriously violate our Acceptable Use Policy.

You may cancel your subscription at any time from within the app or by contacting support. On termination, your right to use the service ends. We will retain or delete your data as described in our Privacy Notice. Admins can export their business data from Settings before cancelling.

12. Changes to the service or these Terms

We may modify the service or these Terms from time to time. If we make material changes we will give reasonable advance notice (for example, by posting in the app or emailing the account owner). Continued use after the change takes effect constitutes acceptance.

13. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets.

14. Force majeure

Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, labor disturbances, internet or telecommunications failures, or governmental actions.

15. Governing law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules. Where mandatory consumer protection law in your country of residence gives you stronger rights, those rights are not affected.
